01 Program overview
This page describes the SMS (text message) program operated by GenXus Consulting LLC ("GenXus," "we," "us," or "our"), a Texas limited liability company based in the Houston, Texas area. Our SMS program is called "GenXus Consulting" and is used to communicate directly with prospective and existing clients about consultations, projects, and account-related matters.
These messaging terms apply in addition to our Privacy Policy and Terms of Service. By opting in to receive text messages from us, you agree to the practices described on this page.
02 Consent to receive messages
When you provide your mobile phone number to GenXus Consulting through a form on our website, a booking page, an intake document, an email reply, or by giving it to us during a call or meeting, and you check a box, reply with an affirmative keyword (such as YES or START), or otherwise indicate your agreement, you are providing your express written consent to receive text messages from GenXus Consulting at that mobile number, sent via an automatic telephone dialing system or similar technology.
Consent is not a condition of purchase. You do not have to agree to receive marketing or promotional text messages in order to engage GenXus Consulting for paid services. You may always communicate with us by email or phone instead.
By opting in, you confirm that the mobile number you have provided is your own (or that you are authorized to provide it) and that you are at least 18 years old.
03 Types of messages we send
Depending on how you engage with us, SMS messages from GenXus Consulting may include:
- Appointment and consultation confirmations
- Appointment reminders and reschedule notices
- Follow-up messages after a discovery call or scoping meeting
- Project status updates, milestone notifications, and delivery confirmations
- Account, billing, and payment-related notices
- Replies to questions you have sent us
- Occasional informational updates about services you have engaged us for
We do not send recurring marketing or promotional SMS blasts under this general consent. If we ever launch a separate promotional SMS list, it will require its own distinct opt-in.
04 Message frequency
Message frequency varies based on your engagement with GenXus Consulting. You should generally expect a small number of messages per week during active engagements (for example, when a consultation is scheduled or a project is in flight), and very few or no messages between engagements.
05 Message & data rates
Message and data rates may apply. Standard message and data rates charged by your mobile carrier apply to all messages sent to or from your device. GenXus Consulting is not responsible for any charges imposed by your carrier. Please contact your wireless provider for details about your messaging plan.
06 HELP — get assistance
At any time, you can reply HELP to any text message you receive from GenXus Consulting to get information about the SMS program and how to reach us. You can also email rened@genxusconsulting.com or call +1 (832) 838-4988 for assistance.
07 STOP — opt out of messages
You can opt out of receiving SMS messages from GenXus Consulting at any time by replying with any of the following keywords to a text message we have sent you:
- STOP
- UNSUBSCRIBE
- CANCEL
- END
- QUIT
After you send one of these keywords, we will send you a final confirmation message acknowledging that you have been unsubscribed, and you will not receive any further SMS messages from GenXus Consulting unless and until you opt back in. To opt back in, reply START or contact us directly and confirm your re-enrollment.
Note: Opting out of SMS does not opt you out of email, phone calls, or other forms of communication you have separately consented to. Account-related notices that we are legally required to send may still be delivered by other means.
08 Revoking consent another way
If you cannot reply STOP for any reason, you can revoke your consent to receive SMS messages from GenXus Consulting by emailing rened@genxusconsulting.com with the subject line "SMS STOP" and including the mobile number you want unsubscribed. We will process your request within a reasonable time and no later than ten (10) business days.
09 Supported carriers & disclaimer
The GenXus Consulting SMS program is available on most major U.S. wireless carriers, including AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, Boost, Cricket, MetroPCS, and others.
Carriers are not liable for delayed or undelivered messages. Your carrier may not support every feature of our SMS program, and message delivery is subject to the effective transmission from our messaging provider and your wireless carrier. GenXus Consulting does not guarantee that messages will be delivered to you in a timely manner or at all.
10 A2P 10DLC & sender ID
GenXus Consulting sends business text messages using Application-to-Person (A2P) 10DLC messaging through our messaging provider, Twilio Inc., on a registered business sender. Messages will arrive from a U.S. ten-digit long code (10DLC) phone number associated with GenXus Consulting. We do not use shared short codes for client communications.
11 Privacy of SMS data
The mobile phone number you provide and any messages you exchange with us are handled in accordance with our Privacy Policy. Key points specific to SMS:
- We do not sell or rent your mobile phone number.
- We do not share your mobile phone number with third parties for their own marketing purposes.
- We share your phone number only with service providers (such as Twilio and our CRM) that help us deliver messages to you, and only under contractual confidentiality and data-protection obligations.
- Mobile opt-in data and consent records are kept private to GenXus Consulting and are not shared with any third parties or affiliates for marketing purposes.
12 Eligibility & minors
Our SMS program is intended only for individuals who are 18 years of age or older and who are residents of the United States. You must be the account holder or authorized user of the mobile phone number you submit. We do not knowingly send SMS messages to children under 18. If you believe a minor has provided us with their mobile number, please contact us so we can remove it.
13 Changes to these terms
We may update these SMS messaging terms from time to time to reflect changes in our practices, our messaging provider, applicable law, or carrier requirements. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify active subscribers by SMS or email. Continued participation in the program after changes take effect constitutes your acceptance of the updated terms.
14 Governing law
These SMS messaging terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising from or related to these terms or our SMS program will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the jurisdiction and venue of those courts.
Nothing in this section limits any rights you may have under the federal Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, the Texas Business and Commerce Code, or other applicable consumer-protection laws.
